Marginly Terms of Use (EULA)

The short version
Marginly helps you estimate your resale profit. It is a calculation tool, not accounting or tax advice. Paid plans renew automatically until you cancel in your Apple ID settings. Your data stays on your device.
1. Agreement
These Terms of Use (the "Terms") are a license agreement between you and MaanLabs ("MaanLabs", "we", "us"), not Apple Inc. ("Apple"). They govern your use of the Marginly app, including any updates (the "App"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms are based on Apple's standard Licensed Application End User License Agreement and are meant to be read together with it. If these Terms conflict with Apple's minimum terms in section 3 or with Apple's Media Services Terms and Conditions, the Apple terms control where they apply.
2. License
MaanLabs grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions (including the Usage Rules). You may not copy, modify, reverse engineer, decompile, rent, lease, sell, sublicense or create derivative works of the App, except where applicable law allows it despite this restriction. The App is licensed, not sold. MaanLabs and its licensors retain all rights not expressly granted.
3. Apple's minimum terms
- Acknowledgement. These Terms are between you and MaanLabs only, not Apple. MaanLabs, not Apple, is solely responsible for the App and its content.
- Maintenance and support. MaanLabs is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support. You can reach us through our contact form.
- Warranty. MaanLabs is solely responsible for any product warranties. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. MaanLabs, not Apple, is responsible for addressing any claims relating to the App or your possession or use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or similar claims.
- Intellectual property. If a third party claims that the App infringes their intellectual property rights, MaanLabs, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims about the App can be directed to MaanLabs through our contact form.
- Third-party terms. You must comply with applicable third-party terms when using the App, such as your wireless data service agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
4. Marginly Pro subscriptions
Marginly is free to use with limits: up to 25 active (unsold) items and 25 recorded sales. Marginly Pro removes those limits and unlocks additional features, such as adding your own marketplaces, saving custom default platform fees and CSV report export. Marginly Pro is offered as an auto-renewing subscription:

Prices are shown in US dollars. In other countries the price is shown in your local currency, including applicable taxes, in the App Store before you confirm a purchase.
- Payment. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal. Your subscription renews automatically at the price of the plan you chose unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Managing and cancelling. You can manage your subscription and turn off auto-renewal at any time in your Apple ID Account Settings after purchase (on iPhone: Settings → your name → Subscriptions). Deleting the App does not cancel your subscription.
- No partial-period refunds by us. Cancelling stops the next renewal; you keep access until the end of the paid period. Apple handles all payments and refund requests (see Apple's refund information).
- Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Price changes. If we change a subscription price, you will be notified as required by Apple and by law, and the new price applies only after the notice period and, where required, your consent.
- Restoring purchases. You can restore an active subscription on a new device by using Restore Purchases in the App.
5. Financial and tax disclaimer
Marginly provides operational calculation estimates only. MaanLabs is not a certified public accountant, bookkeeper, or licensed tax advisor, and nothing in the App, its exports or this website is accounting, tax, legal or financial advice.
- Marketplace fee presets are estimates based on published standard rates. Marketplaces change their fees often, and actual fees depend on category, shipping method, promotions, taxes and other factors. Always check the figures against your own sale records.
- Profit, margin and report figures depend entirely on the data you enter. We do not verify them.
- CSV exports, including any Schedule C-style or ledger-style labeling, are a bookkeeping aid. Tax categories, deductions and filing obligations vary by person and country. Consult a qualified accountant or tax professional before relying on any figure for tax filings, loans, or business decisions.
- You are solely responsible for your own records, tax filings and compliance with the rules of the marketplaces you sell on.
6. Your data
The App stores your data only on your device, and you own it. See our Privacy Policy for details. You can export a raw-data backup at any time and restore it later; this is available to all users. Because the App has no cloud copy, you are responsible for keeping backups. If you delete the App, lose your device or reset it without a backup, your data may be unrecoverable.
7. Acceptable use
You agree not to use the App unlawfully, to interfere with or circumvent its features or the subscription system, or to use it in a way that infringes the rights of others.
8. Intellectual property
The App, including its design, code, text and branding, is owned by MaanLabs or its licensors and is protected by intellectual property laws. Marketplace and platform names mentioned in the App (such as eBay, Poshmark, Mercari, Depop, Vinted, Wallapop, Mercado Libre and Facebook) are trademarks of their respective owners. MaanLabs is not affiliated with or endorsed by them.
9. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any calculation will be accurate or suitable for your purposes. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, MaanLabs and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the App, including any decision made or tax filing prepared using figures from the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid for the App in the 12 months before the claim or US $50. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory consumer rights.
11. Termination
These Terms apply until terminated. They end automatically if you breach them. You may end them at any time by deleting the App (and cancelling any subscription as described above). Sections that by their nature should survive termination will survive.
12. Changes
We may update these Terms from time to time. We will post the updated version here with a new effective date. Continued use of the App after an update means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which MaanLabs is established, without regard to conflict-of-law rules, except that nothing here removes any mandatory consumer protection rights that apply where you live.
